Jenelle left her husband in January when she accused him of cheating on her — and then filed charges against him for assaulting her and their unborn baby. But her lawyer Dustin R. T. Sullivan reveals to HollywoodLife.com EXCLUSIVELY why she hasn’t served divorce papers yet.

Jenelle Evans‘ short-lived marriage to husband Courtland Rogers ended with a tragic miscarriage of her seven-week pregnancy, and six assault charges against him. But they could be legally married for up to another year, her lawyer Dustin R. T. Sullivan tells HollywoodLife.com EXCLUSIVELY.

Even though it seems all signs of their marriage are over — Jenelle filed charges on Jan. 23 and moved in with her ex-fiance Gary Head just days later — Dustin reveals that they’ll be binded by law for a lot longer than they probably want to be.

“North Carolina requires a one year separation period before she’s even elligible to be divorced,” Dustin tells HollywoodLife.com, adding the state has this law to prevent quick divorces.

But because Jenelle filed charges on Jan. 23, he doesn’t think she has spoken with him since the last day of the alleged assault offense. ”Safe to say that they are separated,” Dustin says, so their separation period will likely be over at the end of January in 2014.

Jenelle had mentioned on Twitter that she wanted to get an annulment — but Dustin thinks that’s unlikely.

“It’s an option; it’s extremely difficult to get an annulment in North Carolina,” he tells HollywoodLife.com. “I’ve instructed her to just hold off on any of that [divorce or annulment filings] until she gets the criminal charges worked through.”

Sounds like their relationship is over for good — and we’ll be seeing divorce papers in January 2014! But with Jenelle’s relationship history, it’s hard to tell.
