The judge presiding over the mass shooting case in Aurora, CO., put in a ‘not guilty’ plea on James’ behalf since his lawyer said they weren’t ready to enter their own plea by the deadline.
James Holmes did not say that he is innocent for killing 12 individuals and wounding 58 others in July of 2012 but a judge was forced to put a not guilty plea in since he and his attorney didn’t meet the deadline on Mar. 12.
Judge Enters Not Guilty Plea
James is charged with 142 crimes stemming from the tragic shooting spree in on July 20. He is charged with 24 first degree murder counts and 116 counts of attempted murder. Although he only killed 12 people, he was formally charged with this because he is facing two separate charges for each person either injured or killed during the shooting.
James is also charged with having possession of explosives and for “booby trapping” his apartment.
If found guilty, he could spend the rest of his life in prison or get the death penalty. He could also change the plea to not guilty due to insanity.
As of right now the judge has put a “gag order” on the lawyers and law enforcement officials.
We told you that on eyewitnesses on the day of the attack said that James “entered through the emergency exit at the front of the auditorium and began firing into the audience with a rifle and two handguns as he made his way up the stairs, picking his victims at random.”
