An 8-year-old boy is being a hailed a hero after he escaped from a crashed vehicle, and bravely ran barefoot to get help for his dad, who was trapped in the driver’s seat. However, the father is now facing charges for speeding — do YOU think that’s fair?

Joshua Garcia, 8, was driving with his father Eugene Garcia in Massachusetts when their car hit a a guardrail, and frighteningly flipped over into the Nashua River. Joshua bravely escaped the vehicle, and ran more than a mile home to alert his mom to call 911 to rescue his dad. But after the accident, Eugene will be facing charges after authorities believe he was driving too fast.

Eugene and Joshua were traveling back home to their Fitchburg, Mass. home around 3 a.m. early on July 4. Suddenly, the car hit a guardrail, went airborne and flipped over into a sand bank on the Nashua River below.

The car landed upside down, and Joshua quickly realized his dad was stuck on the driver’s side. Amazingly, Joshua — who was wearing his seatbelt — was able to free himself from the car, swim to shore and run barefoot more than a mile to his house.

When he got home, Joshua woke up his mother, who called 911. Once rescuers arrived on the scene, they were able to free Eugene from the car, who was still awake and alert.

“He is a hero,” Paul McNamara, traffic specialist for the Fitchburg Police Department, told ABC News. The father and son were treated at nearby Health Alliance hospital, and were shortly released.

However, soon after they were released from the hospital, Joshua was taken to the Department of Children and Family Services on July 4, according to ABC News.

Although the specific details of the charges won’t be released until they are actually filed, Brian Belliveau, deputy fire chief for the Fitchburg Fire Department, told ABC News he believes the father could have been driving excessively fast.

Police are also looking into if drugs or alcohol were involved, and why they were out so late, which is illegal in the state.

But there’s not denying Joshua is a hero, and made the right choice when he ran for help.

What do YOU think of Eugene facing charges, HollyMoms? Do you think he should be charged with a crime?
